Applicant Disclosures and Authorizations

THE TERMS AND CONDITIONS WHICH FOLLOW CONSTITUTE AN INTEGRAL PART OF THE APPLICATION. PLEASE READ THESE PROVISIONS CAREFULLY.

Farm Credit Services of America, PCA (“FCSAmerica”) is the master servicer of the AgDirect_® program, and FCSAmerica employees on the AgDirect team are available to assist you with your application.

You may apply for financing through the AgDirect program in the following ways: 

• Online
• AgDirect equipment dealership
• Participating Farm Credit System Institution

Your request will be handled by the AgDirect team at FCSAmerica.  Depending on the nature of your request, your application may be reviewed by FCSAmerica, Farm Credit Leasing Services Corporation (“FCL”), Cooperative Credit Company (“CCC”) and/or the AgDirect equipment dealer selling the equipment to you.  By submitting an application for financing in connection with the AgDirect program, each applicant (“Applicant”) agrees as follows:

1. This application is a request for services submitted to FCSAmerica and/or the party offering financing.
2. The information provided herein will be used to process your request, for normal maintenance and servicing of your account, for general business operations (including portfolio and risk analysis), for marketing of financial products and services to you, and for providing future services, transactions and request you may submit to FCSAmerica and/or the party offering financing.
3. The application will be evaluated on behalf of the party providing financing, as appropriate, and approval of any retail installment contract, loan, or lease is at the sole discretion of the party providing financing. 
4. Applicant understands that parties who assist with the application process are not authorized to extend commitments for financing or leases or any terms thereof, including annual percentage rate, interest rate or lease terms, and applicant will not construe any discussion such persons as a commitment for financing.
5. Applicant authorizes the parties that offer financing to notify each other of any decision on Applicant’s application.
6. Subject to applicable law and contractual obligations with credit reporting agencies, the parties who offer financing may obtain and share credit reports, employment and income verifications, or any other information relating to Applicant’s financial position for the purpose of making a decision on any application for financing and for any other legitimate purpose allowed by law.
7. The parties that offer financing may provide Applicant’s information to AgDirect, LLP, other Farm Credit System institutions, or entities controlled or owned by Farm Credit System Institutions, or other financial institutions as a part of a sale, assignment, or participation in the financing, and as otherwise allowed or required by law or regulations.  Said information may thereafter be used by such institutions for any lawful purpose.
8. Applicant certifies and acknowledges that any person is hereby authorized to provide any such information requested by the parties that offer financing for the purpose of making a decision on any application for financing.
9. Applicant certifies and acknowledges that the information provided in an application is correct to the best of Applicant’s knowledge.
10. Applicant certifies and acknowledges Applicant may be required to supply additional information and to provide security for requested financing.
11. Applicant acknowledges receipt of a copy of this Applicant Disclosures and Authorizations document and deems submission of the application to be Applicant’s written consent to all of the above.
